1DataSIM - Terms & Conditions
1. Definitions and framework
1.1 www.1datasim.com (hereafter referred to as the “website”) is the electronic shop via which products and services are sold by Zilos Data Ltd (hereafter referred to as “Zilos Data”, “we”, “our” or “ours”), whose head offices and registered office is at 10C Olymbou Street, Latsia, 2234 Nicosia, Cyprus and with registration number is HE 399759. The VAT registration number of Zilos Data is 10399759O.
1.2 The present terms and conditions shall be applied for the use of the website and any products or services sold thereon. The users must ensure that they read carefully the present terms and conditions and comply with them prior to the use of the website. The mere use of the website signifies the acceptance of the users with such terms and conditions.
1.3 The 1DataSIM data SIM card (hereafter referred to as “1DataSIM”) is a pay as you go data SIM Card, which supports 4G/3G/2G and which can be installed into SIM-enabled devices for either Standard SIM, Micro-SIM and Nano-SIM sizes (i.e. a smartphone, tablet, laptop, MiFi device, etc.), in order to use mobile data services (hereafter referred to as the “Services”). The Services are based on the KPN Holland mobile roaming services and are limited to the countries where KPN Holland has signed a mobile roaming agreement, and subject to the conditions of such mobile roaming agreements. 1DataSIM may not be used as a domestic SIM card on a permanent basis in any of the countries listed on the website www.1datasim.com; 1DataSIM must solely be used in such countries for short-term periods or for temporary use, such as during periodic travelling. KPN Holland is the trade name of the Koninklijke KPN N.V., a company being a mobile network operator based in the Netherlands, Wilhelminakade 123, 3072 AP Rotterdam, and registered and subsisting in the Trade Register of the Netherlands under number 27124701. The VAT registration number of KPN Holland is NL009292056B01.
1.4 The 1DataSIM prepaid Top Up Card is a card that can be redeemed for credits on the website www.1datasim.com in order to top up the 1DataSIM for the use of Services.
1.5 The 1DataSIM and Services are further described on the website: www.1datasim.com.
1.6 No mobile number is given to the customer who has purchased 1DataSIM and Services (hereafter referred to as the “Customer”, “you”, “your” or “yours”) and the Customer cannot make phone calls (even emergency calls) or send SMS with its 1DataSIM. The 1DataSIM is only enabled for mobile data.
1.7 The countries where the Customer can use the 1DataSIM are detailed on the website www.1datasim.com and depending on the Service purchased.
1.8 The 1DataSIM is sold directly by Zilos Data on its dedicated website or is sold by Zilos Data independent distributors and resellers.
1.9 The 1DataSIM pricing is detailed on the website: www.1datasim.com.
1.10 The Customer must subscribe, activate and/or top up the Services through our website by creating a Customer personal account that is called ‘My 1DataSIM account’.
1.11 “Personal Data” means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identity document, an identification number, location data, economic data, an online identifier or to one or more factors specific to the physical identity.
Agreement with Customer
2.1 These terms and conditions will apply between Zilos Data and the Customer when the Customer subscribes to the Services and will be considered to be the binding contract between Zilos Data and the Customer (hereafter referred to as the “Agreement”). The Agreement between Zilos Data and the Customer will continue until terminated upon full use of the Services or expiry of the Services or as otherwise set out in this Agreement.
Right of Withdrawal
2.2 Where you have entered into this Agreement with us through our website, you have the right of withdrawal of this Agreement any time within fourteen (14) days, by contacting the customer service department by e-mail to: . These are clear days (full day from 0 to 24 hours) and business days (Monday to Friday; only Saturday, Sundays and official public holidays are not business days). However, you will not be able to withdraw if the product is not in a brand new condition, in case it is not fully sealed from the manufacturer or not in its original packaging, and in case you make your first use of the Services i.e. make a data connection before the end of the 14-day period. If you exercise this right, then we will refund any remaining credit associated with your account excluding any return delivery charge which will be borne by yourself, as described in Clause 31.11 of this Agreement. Any promotional offers or free Services will not apply when you decide to withdraw in accordance hereto.
2.3 To implement your right of withdrawal for SIM(s) or product(s), you must inform us in writing, within the timeframe stated above, by email to: . A confirmation reply will be sent upon receipt of your request with details about how to proceed with returning your SIM(s) or product. A refund, excluding shipping costs, will be provided upon receipt of the returned SIM(s) or product to our warehouse. The cost of returning the SIM(s) or product will be the responsibility of the consumer. Please note that the product must be in brand new condition, fully sealed from the manufacturer in its original packaging, and unused when being returned. Please include a copy of your payment receipt together with your return. Only SIM cards purchased directly from www.1datasim.com can be accepted for return.
2.4 To implement your right of withdrawal for data plans, you must inform us in writing, within the timeframe stated above, by email to: . A confirmation reply will be sent upon receipt of your request with instructions about how to proceed in case your request is not exempt from the right of withdrawal in accordance with the restrictions set out in Clause 2.2 herein above. For the avoidance of doubt and in addition to any other eligibility requirement, a refund will be provided only if you have not activated and used the Services. If you have activated the Services a refund shall not be provided.
2.5 Top Up Scratch Cards are non-refundable and non-transferable.
2.6 All Services, including any related offers and promotions may be subject to specific additional terms and conditions advertised in our marketing literature and / or on the website. Please check our website regularly as these terms and conditions may be updated from time to time.
2.7 You will remain responsible to us under this Agreement for the actions of any other person you allow to use the Services, where we have not consented to a transfer of this Agreement.
2.8 In instances where a product or service provided and/or sold, or to be provided and/or sold in the future on the website, is governed by any other special terms, these terms shall be read in conjunction with those special terms. In instances of conflict, the special terms that apply shall prevail. Regarding our offers there might apply special terms and conditions, which can be found on the website.
3. Our obligations
3.1 Zilos Data will provide the Services in accordance with the Agreement, and as described in the price plan, applicable on the date of activation of the 1DataSIM , as this is posted on the website on the date of activation of the 1DataSIM.
3.2 We try to make sure that the Services are available to you wherever possible; however both availability and quality of the Services may be affected by things we cannot control such as physical obstructions, atmospheric conditions and outages on the network where such outages and their remedies are not within our control. We or KPN Holland may from time to time need to carry out upgrades or maintenance works on the Network which may affect the availability and/or quality of the Services. We will endeavor to keep such disruption to a minimum but this may not always be within our control.
3.3 We shall provide the Services with reasonable skill and care and we shall use reasonable efforts to make the Services available to you. If you experience problems with our Services or suspect a fault, please contact us, as per Clause 16 of this Agreement.
3.4 We may from time to time and without notice, change the Services in order to comply with safety, regulatory, statutory and other requirements. We will try to ensure that this does not materially affect the scope of the Services.
3.5 If the Service is interrupted for more than two (2) days, or if the lead-time for delivery of 1DataSIM is more than three (3) weeks after the date you have entered into this Agreement, you are entitled, provided this interruption or this delay is attributable to a breach by Zilos Data (and not to a breach by the carrier company or otherwise), to request from Zilos Data a refund corresponding to the proportion of the price which you paid whilst not having access to the Service.
4. Your obligations
4.1 You must use the Services in accordance with this Agreement, and any other reasonable instructions we give you from time to time.
4.2 The 1DataSIM does not have PIN code by default. You can configure a PIN code by yourself from your device if you wish to. You must inform us immediately if your card has been lost or stolen.
4.3 You agree that you will always comply with this Agreement and that we and our Network Operator have the rights set out in this Agreement. You will be responsible to us for any losses, expenses or other costs incurred by us, without limitation, as a result of your breach of this Clause.
4.4 You must create a Customer personal account that is called ‘My 1DataSIM account’ on our website www.1datasim.com in order to make purchases and / or top up your 1DataSIM and / or use the Services you have purchased.
4.5 You acknowledge that Zilos Data may suspend immediately certain Services in case they do not comply with any applicable laws.
4.6 You are responsible for the way you use the Services and we will not be responsible for any content sent or received by you.
4.7 You are responsible for updating us as soon as reasonably possible of any changes to your contact details.
4.8 You are responsible to activate your 1DataSIM on our website in order to use the Services you have purchased.
4.9 You shall not use 1DataSIM on a permanent basis in any of the countries listed on the website www.1datasim.com. In the event where 1DataSIM is used on a permanent basis in such countries and/or in the event where any improper use is detected, we shall suspend immediately the Services without any prior notification. Use of the Services for periodic travelling is not included in the scope of the present obligation.
5. 1DataSIM and Prepaid Top Up Scratch Cards
5.1 All 1DataSIM cards purchased by you remain the property of Zilos Data. We may replace your 1DataSIM at any time during this Agreement and may also require you to return your 1DataSIM to us.
5.2 You must advise us and inform us in the event your 1DataSIM is lost, stolen or damaged. We will replace any , free of charge if it is defective, however we reserve the right to charge you for a replacement where a 1DataSIM appears to have been damaged by deliberate misuse or negligence.
5.3 Prepaid Top Up Scratch Cards (hereafter referred to as the “Scratch Cards”) are non-refundable and non-transferable. Zilos Data is not liable for any lost or stolen Scratch Cards. Scratch Cards should only be purchased from authorised resellers only. You should not accept a card that has been damaged or where the ‘scratch here’ area has been revealed.
5.4 Scratch Cards work in the following way: Scratch Cards can only be redeemed on our website. In order to redeem your scratch card, you must have or create a Customer personal account. To redeem your Scratch Card, you must click on Top Up with Scratch Card, enter the scratch code that is on the back of the Scratch Card, and click on the redeem button. By redeeming your Scratch Card, the value of your Scratch Card is redeemed for the same amount in credits. The credits are saved in your account and you can use them to purchase the data plan that you choose from the data plans available on the website. You can redeem and use as many Scratch Cards as you want. Any credits remaining after purchases are saved to your account and can be used in the future for more top ups. Scratch Cards and credits are non-refundable and non-transferable at any time. Scratch Card credits do not expire and can be used any time after redeeming.
6. Credit and charges
6.1 Your use of the Services is charged in accordance with the 1DataSIM pricing rates applicable to your chosen data plan or data bundle on the date of activation of 1DataSIM. All available price plans and products are published on the website and will be regularly updated with price changes and any special offers. You may also contact Customer services and request details of our prices or any price change at any time.
6.2 Scratch Cards credits may only be redeemed for Services and you will not at any time be entitled to receive any cash refund for any remaining credit or allowance unless expressly stated otherwise in this Agreement. Credit and allowances are also not transferable and not refundable, and no interest will be applied or payable to credit balances or allowances.
6.3 Your Customer personal account may automatically be closed, and your 1DataSIM deactivated twenty-four (24) months during which you did not use the Services and pay for such a using.
8. 100MB Free Data
8.1 When a Customer purchases Services from our website, for the first time only the Customer will automatically receive an extra 100MB of data at no charge. This applies only to first purchases of data plans per 1DataSIM ICCID and expires at the end of the data plan period purchased.
9. Data Connectivity
9.1 There may be approximately up to fifteen (15) minutes delay from the moment when a data plan or top up is purchased to the time that the 1DataSIM can be used on the device.
9.2 1DataSIM cards are 4G/3G/2G compatible. Your connection speed will vary depending on your exact location and connected network at the time of usage. Zilos Data cannot control or change networks and/or network speeds.
10. Data Expiration
10.1 All data plans have an expiration date. Data plans are available for the following periods: fourteen (14) days and thirty (30) days. Depending on the data plan purchased, the plan will begin from the date that you purchase your data plan and will expire at the end of the specified period of the data plan, unless you have used all of your data allowance specified in the data plan purchased before the expiration date. In this case, your 1DataSIM will be de-activated and you must purchase a new data plan. For new customers that purchase a SIM together with a data plan, the plan will begin from the date that you install the 1DataSIM in your device and will expire at the end of the specified period of the data plan, unless you have used all of your data allowance specified in the data plan purchased before the expiration date. In this case, your 1DataSIM will be de-activated and you must purchase a new data plan.
11. When we may suspend or disconnect
11.1 We may, without liability to you, suspend or disconnect you fully or partially from the Services, without notice:
a) If we are entitled to terminate this Agreement due to your failure to comply with this Agreement but elect to provide you with an opportunity to remedy such failure whenever reasonably practicable.
b) If we are required to do so under applicable law by the competent authorities and/or emergency service organisation or any other competent body or regulatory or supervisory authority.
c) For repairs or maintenance, or for operational or security reasons.
d) In circumstances where we observe fraudulent or unusual use of your account or one or more Service, including without limitation abnormal high usage patterns.
e) If we have a good reason to suspect a breach by you of this Agreement.
f) If you advise us that your 1DataSIM has been stolen, lost, damaged or destroyed.
g) If your 1DataSIM or device within which the 1DataSIM is inserted, is interfering with the normal operation of the network.
h) If you do not use the Service in compliance with the applicable laws and regulations, and other conditions included in the mobile roaming agreements of KPN Holland.
i) If the Services are used on a permanent basis, other than for periodic travelling, in any of the countries listed on the website www.1datasim.com.
12. Changing the Agreement
12.1 This section applies to all changes to the Agreement except changes to our charges, which are already described above.
12.2 We can change or update the Agreement at any time. We will only do this if we have a valid reason, for example, including without limitation, to reflect changing arrangements with our roaming partners, or changing legal, regulatory or business requirements.
12.3 Where we make a significant change to this Agreement, we will notify you about this change and also place details on the website. If you do not agree with a significant change to this Agreement, you may stop using the Services and terminate the Agreement.
13. Website access
13.1 Zilos Data shall make every effort to maintain the availability of the website at all times. Customers nonetheless accept that Zilos Data has the right to modify or discontinue temporarily or permanently all or part of the website with or without prior notice to Customers. Consequently, Zilos Data accepts no responsibility and/or liability for any kind of damage (direct, indirect, negligently, contractual or other) due to the inability of Customers to access the website, the cessation of all or portions thereof, delay, non-delivery, interruption or poor quality of service, loss of contents or the existence of any such errors. In any case, Zilos Data reserves the right to discontinue at any time temporarily or permanently, the operation of the whole or part of the website for maintenance or upgrade purposes or for any other reasons it sees fit.
13.2 We do not make any warranty as to the accuracy, completeness, reliability or continuous supply of the content or information contained on any third-party sites or resources accessed via the Services.
13.3 Zilos Data shall make every effort to protect the website from virus. Nevertheless, we will not be responsible for any harm you suffer from any virus that gains access to your hardware equipment or device, whether transmitted via the Services or otherwise. It is the Customer’s responsibility to protect their hardware equipment or device, with suitable anti-virus software prior to the use of the website.
14. Online payment terms & conditions
14.1 Zilos Data can ensure its Customers that the online payment process is completely secured for the payment gateway - JCC Payment Systems Ltd (hereafter referred to as “JCCSmart”) which is available on the website for the purchase of Services. JCCSmart uses SSL (Secure Socket Layer) protocols to encrypt Personal Data such as credit card numbers, contact details and name. SSL is a standard protocol used for the secure transmission of documents over a network. and creates a secure link between a Web server and browser to ensure private and integral data transmission.
14.2 For JCCSmart, the payment can be processed by credit card or debit card. The credit or debit card will be charged after verification and certification of its data and validity. The Customer is responsible for the proper submission and true details of the credit card. Payment may be processed via credit, debit and prepaid cards issued by a Cypriot Bank. The payment service above is offered in collaboration with JCCSmart which provides special systems for the safe transmission of data of the credit/ debit card. By submitting your credit card or debit card data, you acknowledge and agree that Zilos Data in collaboration with JCCSmart will charge the credit, debit or prepaid card you have submitted for the amount of the transaction. Your card data is collected directly by JCCSmart without Zilos Data’s intervention and Zilos Data does not have access to data such as card number, expiry date and cvv2. Therefore, Zilos Data shall accept no liability for any issue occurring with regard to any of the aforementioned credit, debit or prepaid card data.
14.3 Zilos Data takes all necessary measures to ensure security of data and transactions made through the website www.1datasim.com. The transaction details (transaction number, subscriber name, amount of payment, IP address) which Zilos Data collects and processes are used exclusively and solely for the purpose of receiving, effecting, and completing payment in accordance with its obligations under this Agreement. They are not announced nor transmitted by Zilos Data to any third party with the exception of the payment gateways which is a collaborator for this service, and they are deleted once the purpose for which they were retained has been fulfilled. You acknowledge and accept, the right of Zilos Data as well as the right of JCCSmart to process your Personal Data in accordance with Clause 15, when using the Service.
14.4 Zilos Data reserves the right to refuse and block any top up or suspend usage for any fraudulent usage of the Services being performed by any Customer.
15. Protection of Personal Data
15.1 Your Personal Data is collected by Zilos Data to provide the Services in compliance with the Agreement, to comply with our legal obligations under relevant laws and regulations e.g. about Customer identification and in case you may have expressly asked us to do something or have otherwise given your clear consent to us to process your Personal Data. Zilos Data undertakes to take all necessary steps to ensure the protection and confidentiality of your Personal Data and may not use it for purposes other than ones based on which we have selected it. Personal Data will be erased within five (5) years from the date of termination of the Agreement in case of an identification obligation, unless a longer retention period is imposed or permitted by the applicable law.
15.3 In particular, the security and the confidentiality of your Personal Data will always be protected in compliance with the GDPR, even if you are not a national of a Member State of the European Union.
15.4 You hereby agree and acknowledge that your Personal Data may be transferred to third parties, solely for the performance of the Services under this Agreement or as may be consented by you or otherwise required under applicable law. The processing of your Personal Data is only to be executed by Zilos Data or its subcontractors, provided such subcontractors are subject to contractual clauses with Zilos Data in accordance with the GDPR.
15.5 In case of transfer of your Personal Data outside of the European Union, a similar protection to the European regulation will be provided.
15.6 We shall notify you without undue delay of becoming aware of any actual Personal Data breach and provide an appropriately detailed description of the breach, the type of Personal Data that was the subject of the breach (if aware), the identity of the affected persons, as soon as such information becomes available, together with all other information and cooperation which you may reasonably request relating to the breach.

17. Applicable Law and Jurisdiction
17.1 The Agreement and use of the website shall be governed by all applicable laws of the Republic of Cyprus. Customers hereby consent to the exclusive jurisdiction and venue of the courts of the Republic of Cyprus in all disputes (a) arising out of or relating to the use of the website and/or this Agreement, (b) in which the website and/or this Agreement is an issue of fact.
18. Product and Service Information
18.1 Zilos Data is committed to ensure that the quality and completeness of the information provided on the website is accurate at all times with regards, to the identity of the website and for the services provided. Specifically, Zilos Data shall accept no liability for any defective products and/or inaccurate or untrue information concerning its supplier’s goods contained within the website. Such liability rests upon Zilos Data’s individual suppliers.
19. Limitation of Liability
19.1 Zilos Data has no liability to any Customer for damages that may occur due to the execution of their order. Zilos Data reserves its right regarding the delivery time of the products in cases of force majeure.
19.2 The website cannot guarantee the availability of the products or Services, but it guarantees that it shall inform the Customers of the website on a timely basis.
19.3 The website provides the content (e.g. information, names, images, and illustrations), the products and services available through the website “as is”. In no event will Zilos Data bear any responsibility for any legal, civil and criminal claim regarding any damages (indirect, special, consequential, which, without limitation alternatively and/or cumulatively constitutes a loss of profits, data, compensation, etc.) caused by any visitors or others, relating to the operation or use of the website and failure to provide services and information available from the use of the website and / or any unauthorised third party interventions in products and / or services and / or information available through the website.
Zilos Data accepts no responsibility in the event of any alterations regarding the product prices as well as a difference between the picture displayed to the actual product purchased by the user.

Any rights not expressly granted herein are reserved.
22. Trademark information
22.1 Zilos Data’s trademarks may be used only with written permission of Zilos Data. Zilos Data and 1DataSIM are registered trademarks or business names of Zilos Data. All other trademarks, brands and business names are the property of their respective owners. Except as expressly specified in this Agreement and legal restrictions, nothing contained herein shall be construed as conferring by implication, estoppel or otherwise any license or right under any patent, trademark, copyright or any proprietary rights of Zilos Data or any third party.
23. Links to other websites
23.1 As a convenience and to make the Zilos Data’s website truly service oriented we have included links to complimentary sites on the Internet. These sites are owned and operated by third parties. Zilos Data makes no representation and is not responsible for the availability of, or content located on or through, these third-party sites. A third-party link accessed from the Zilos Data’s website is not an indication that Zilos Data endorses the third party or its site or has any affiliation with or between Zilos Data and the third party hosting site.
24.1 All comments, feedback, information or materials submitted to Zilos Data through or in association with the website shall be considered non-confidential and Zilos Data’s property. By submitting such comments, information, feedback or materials to Zilos Data, you agree to a no-charge assignment to Zilos Data of worldwide rights to use, copy, modify, display and distribute the submissions. Zilos Data may use such comments, information or materials in any way it chooses on an unrestricted basis.

26. Termination of Use of Website
26.1 Zilos Data may, in its sole discretion, terminate or suspend your access to all or part of the Zilos Data website for any reason, including without limitation, breach of this Agreement. 28.1 The Customers are informed about the availability of the products. The various offers that appear on our website are always available while stocks last and on a first come first served basis. All prices on the site are inclusive of V.A.T. at the rate applicable on the Service upon purchase. Zilos Data reserves the right to change prices without prior notice.
29.1 Upon completion of a purchase through the website, the Customer will receive an order confirmation via e-mail at the email address indicated by the Customer during the placement of the order.
29.2 The order can be cancelled as per the right of withdrawal policy stated in Clause 2.2 above.
29.3 After the completion of the purchase, the order cannot be changed. If the Customer wishes to change his or her order, such order must be cancelled as per the right of withdrawal policy and a new order must be placed.

This limited guarantee is valid for Services which are sold by Zilos Data on our website. In case of product defects, the Customer is obligated to return the product to Zilos Data at the address stated at Clause 16 of the Agreement. All defective items must be complete with box and accessories and in new condition and must be returned within seven (7) days from the day of purchase.
A product is regarded as defective if:
Zilos Data guarantees that the product is at the time of its initial purchase free of faults in its manufacture, materials, design and workmanship under the following conditions and stipulations:
31.1 The present limited guarantee is granted to the Customer. It does not exclude or limit any right of the Customer granted necessarily by law.
31.2 The duration of the guarantee is 24 months. The guarantee begins from the date at which the Customer first bought the product. In case of subsequent purchases or other purchase by the Customer, the duration of the guarantee will be continued for the rest of the initial guarantee period and will otherwise remain unaffected.
31.3 During the validity of the guarantee Zilos Data will repair or replace at their absolute discretionary power any faulty product. Zilos Data will return the repaired product or replaced product to the Customer in good functional state, as per the terms of Clause 31.11 herein below. All the materials or other equipment for which replacements were made will be the property of Zilos Data.
31.4 No extension or renewal of the duration of the guarantee is granted for a repaired product that was replaced.
31.5 The present limited guarantee does not apply to natural wear and tear. It also does not apply in the following cases:
I. the fault was caused by the fact that the product was used in a way contrary to the instructions of the manufacturer or because of hard use, exposure to humidity or extreme thermal of environmental conditions or sudden changes in these conditions, corrosion, rust, non-authorised changes or connections, non-authorised opening or repair by the use of non-authorised accessories, bad use, unsuitable installations, accident, physical phenomena, throwing of food or liquid, effects of chemical products or other effects beyond the reasonable control of Zilos Data (including indicatively faults in consumable parts, such as batteries, which from their very nature have a limited duration of life) except if the fault was caused directly from faults in materials, designs or workmanship.
II. Zilos Data was not informed by the Customer about the fault within seven (7) days as from the appearance of the fault during the time of the guarantee.
III. the product is not returned to Zilos Data within seven (7) days from the appearance of the fault during the time of the guarantee.
IV. the serial number of the product, the code of the date or the number IMEI were withdrawn, rubbed off, changed, or modified or are illegible.
V. the fault was caused by faulty functioning of the network.
VI. the fault was caused by the fact that the product was used or was connected with parts that do not fit the technical character of the product.
VII. the software of the product requires upgrading because of changes in the parameters of the network.
31.6 For the present limited guarantee to apply the Customer should present the original invoice of purchase of the product.
31.7 The present limited guarantee is the only and exclusive means of satisfying the Customer against Zilos Data and the only exclusive obligation of Zilos Data towards the Customer for faults or malfunctioning of the product. The present limited guarantee replaces all other guarantees and obligations either oral or written (non-obligatory) by law, conventional, due to malpractice or otherwise. Zilos Data is in no case responsible for any accidental subsequent or indirect damage, expenses, or outgoings. Zilos Data is also in no case responsible for any direct damage, expenses or outgoing if a Customer is a legal person.
31.8 Any change or modification in this limited guarantee requires the previous written approval of Zilos Data.
31.9 For possible problems of any product which are not expressly mentioned above, Zilos Data bears no responsibility for their repair; in such a case Zilos Data is only responsible to inform the Customer and ask for approval for further charges regarding as possible repair.
31.10 No guarantee is provided for repairs that concern damage which was the result of water damage.
31.11 The Customer will bear any shipping costs related to sending the defective product back to Zilos Data. Zilos Data will bear any shipping costs related to sending the repaired or replaced item back to the Customer.
32. Force Majeure
Zilos Data shall not be in breach of this Agreement nor liable for delay in performing, or failure to perform, any of its obligations under this Agreement, if such delay or failure result from events, circumstances or causes beyond its reasonable control. In such circumstances, Zilos Data shall be entitled to a reasonable extension of the time for performing such obligations. If the period of delay or non-performance continues for 4 weeks, the Customer may terminate this Agreement by giving 7 days’ written notice to Zilos Data.
